Jennifer Lopez and Ben Affleck‘s impending (alleged) divorce comes with a long list of challenges. Amid reports the filing of the paperwork is stalling and the couple isn’t talking, a top New York divorce attorney has weighed in on what could be causing the delays.

Leigh Baseheart Kahn, a partner at Schwartz Sladkus Reich Greenberg Atlas LLP, explains to StyleCaster that there could be a range of reasons. “It could be that they’re still tinkering, someone’s had second thoughts and they want to amend something,” she says.
“It could be a matter of timing… Maybe they want to get by some particular life event before the information is released, because once it’s filed, it’s out there in the public domain, and they can’t really control it,” she continues. “So by waiting to file, it gives them some element of control.”

That timing point does seem to make sense because the couple has a few milestones recently. It was Jen’s 55th birthday on the July 24, it was also their second wedding anniversary on July 16. They celebrated neither date together, either.
Kahn also detailed how their split will be more akin to a “business deal” because they don’t share children (Jen has twins from her marriage to Marc Antony, while Ben has three kids with his ex, Jennifer Garner), especially after reports that say the couple isn’t speaking.
“I have found that the cases involving minor children—since they’re so fraught with emotion—tend to be a bit more difficult,” says Kahn. “[But with Ben and Jen], this is sort of the equivalent of a business deal. Them not talking; it’s not going to sink the deal because each of their respective lawyers can speak to their clients and play a sort of shuttle diplomacy. It’s just finances.”
